A Queenstown family have won a battle to prove that their Swedish au pair's claims of being "dumped" at an airport in Samoa with $20 for "wrecking their holiday" did not stack up.

Amanda Akeson went to the Employment Relations Authority last year, claiming she had been left at Samoa's airport by Janine and Hamish Learmonth to "fend for herself" with only $20.

The Learmonths claimed the nanny refused to work once they arrived at their Pacific resort, when she should have been looking after their children.

The ERA ruled in her favour and ordered her employers, Janine and Hamish Learmonth, to pay her $1189.99 in unpaid wages and holiday pay.

But the Learmonths challenged the decision as they had not had a chance to properly argue their case - and yesterday the ERA reversed its decision. However, the au pair returned to Sweden while the appeal was being heard.

ERA member James Crichton said it had made an error, "which it regretted", by issuing its finding before the Learmonths had filed all their submissions.

The ERA found Mrs Learmonth had taken Ms Akeson to the airport in Samoa, arranged her flight home, stayed with her for up to an hour and left her with $90.

"The authority must again vacate its original conclusion ... and substitute it with a fresh conclusion that, whatever happened when Ms Akeson commenced to leave Samoa for New Zealand, no criticism can be levelled at the Learmonths, based on the evidence now before the authority," the decision said.

Mrs Learmonth said she was "over the moon" with the result.

Perpetual motion 'time crystals' may exist

From diamonds to snowflakes to salt, crystals are common in nature. The arrangement of their atoms in orderly, repeating patterns extending in all three spatial dimensions doesn't just make them nice to look at; crystals are also the vital components of technologies from electrical transistors to LCD screens.

In groundbreaking new research, Nobel-winning physicist Frank Wilczek contends that ?time crystals,? moving structures that repeat periodically in the fourth dimension, exist as well.?

A time crystal would be a physical object whose constituent parts move in a repeating pattern. Think of a kaleidoscope, whose sparkly bits swirl on loop forever, or a clock, whose hour hand completes a 360-degree turn every 12 hours. But unlike clocks or other common objects with moving parts, time crystals would run forever under their own steam ? perpetual motion devices permitted by the laws of physics.

These bizarre objects have never been conceived of previously, but Wilczek, a theoretical physicist at the Massachusetts Institute of Technology and winner of the 2004 Nobel Prize in Physics for his work on the strong nuclear force, thinks they either already exist in nature or could soon be engineered.

Many types of time crystals are possible. ?The simplest realization would be some system whose geometry allows it to move in a circle and come around after a certain time to the same place,? Wilczek told Life?s Little Mysteries. A more complicated configuration could be a collection of atoms moving fluidly in three dimensions but all periodically returning to their starting points.

The characteristic trait of a time crystal, Wilczek says, is that it moves without consuming or shedding any energy. Instead, it is in a stable, minimum-energy state, just as diamonds and other conventional crystals are. Even so, it is also in a state of perpetual motion.

Unlike perpetual motion machines, Wilczek said time crystals would not violate the law of conservation of energy. ?Usually perpetual motion machines are banished because they are not in their ground state, so their energy is expended as they move and they eventually run out. In time crystals, energy is conserved because nothing is taken away. The novelty is that, in these objects, the energy has its minimum configuration, but the velocities (of atoms in the object) are not zero,? he said.

As argued in his new paper, time crystals follow as a natural consequence of what physicists call ?time symmetry breaking.? It works like this: Wherever you are in space, and wherever you are in time, physics works the same way. You could set up a physics experiment, run some tests, then pick up the setup and shift it an arbitrary small distance in any direction, or wait an arbitrarily small amount of time, and run the tests again. You?d get the same results in all the test runs. Space and time are thus said to be perfectly symmetric.

Crystals, on the other hand, must be shifted by set increments in order for their latticework structure to appear identical, and for experimental investigations of the crystals to produce the same results. If, for example, you shifted a diamond lattice so that its atoms moved only halfway to the spot where the adjacent atoms used to be, the lattice wouldn?t look quite the same, and the crystal wouldn't scatter X-rays in the same patterns.?

Thus, because they are slightly less symmetric than space itself, diamonds ?break? the symmetry of space. Wilczek?s big insight is that crystals that break the symmetry of time are allowed to exist, too. And in two new papers, he worked out the math to prove it.

Normal crystals are often imperfect, and Wilczek thinks it might be possible to discover or build an imperfect time crystal ? an object that moves in an almost cyclic manner but is slightly off-kilter in a way that makes it radiate energy, very slowly, for an extremely long time. True time crystals also might exist in nature and are likely to be realizable in the lab, he said.

While they would seem too spectacular to be useless, it?s too early to tell what they?d be used for.

Conservation risk highest off coasts of Canada, Mexico, Peru and New Zealand

ScienceDaily (Feb. 20, 2012) ? University of British Columbia researchers have identified conservation "hot spots" around the world where the temptation to profit from overfishing outweighs the appetite for conservation.

Combining economic outlook and fisheries population growth rates for all countries currently reported to fish in the ocean, UBC fisheries researchers William Cheung and Rashid Sumaila developed a conservation risk index to reveal the economic-conservation trade-offs of fishing.

Areas with the highest risk index -- those most biologically and economically vulnerable to overfishing -- include the northeastern coast of Canada, the Pacific coast of Mexico, the Peruvian coast, the south Pacific (offshore of New Zealand in particular), the southern and southeastern coast of Africa, and the Antarctic region.

"This index is a guide for determining the appropriate conservation and fisheries management policy for each region," says Cheung, an assistant professor in UBC's Fisheries Centre, who presented his research at the Annual Meeting of the American Association for the Advancement of Science (AAAS) in Vancouver, Canada.

"The most vulnerable areas may need to be protected with special management approaches -- such as marine protected areas, while others may benefit from economic incentive instruments to better manage the ecosystems -- such as territorial use rights in fisheries, or TURFs," says Sumaila, professor and director of the UBC Fisheries Centre.

The index can also help conservation managers use scarce resources in a targeted, efficient and effective way to ensure the conservation of sustainable use of seafood and marine ecosystems, Sumaila adds.

"Fishing has a major impact on marine biodiversity, causing the depletion of many species," says Cheung, who grew up in Hong Kong and focused his earlier research on fisheries in the South China Sea -- one of the most over-exploited areas in the world's oceans. "I witnessed how overfishing can damage marine ecosystems and the goods and services they provide -- but in order to solve the problem, we need an understanding of both biology and economics. Biology determines whether a stock is more vulnerable to fishing, while economics determines how strong the incentive is to overfish the stock now."

The conservation risk index is based on the discount rates of fishers and the intrinsic population growth rates of the fish being targeted. The discount rate is a measure of how much a dollar of fish to be received in the future is worth today -- similar to the long-term lending interest rate of central banks. The intrinsic population growth rate is the difference between the birth and death rate of a fish stock.

Cheung and Sumaila used published discount rates data for all countries that are reported to fish in the ocean, and intrinsic growth rate data for major exploited fish species to calculate the conservation risk index for each half degree square area of the world's oceans (2,500 square-kilometres, roughly the size of Metro Vancouver or three times the size of New York City). The higher the conservation risk index, the more vulnerable the area is.

Also, if you've never read it, Angela Davis's book, Blues Legacies and Black Feminism: Gertrude "Ma" Rainey, Bessie Smith, and Billie Holiday is an excellent historical analysis of the little known things about the blues women, for instance, she talks about how "Ma" Rainey was bisexual and challenged a lot of gender conventions of the time through her music.

Here's part of the first chapter

Like most forms of popular music, African-American blues lyrics talk about love. What is distinctive about the blues, however, particularly in relation to other American popular musical forms of the 1920s and 1930s is their intellectual independence and representational freedom. One of the most obvious ways in which blues lyrics deviated from that era's established popular musical culture was their provocative and pervasive sexual--including homosexual--imagery.

By contrast, the popular song formulas of the period demanded saccharine and idealized nonsexual depictions of heterosexual love relationships. Those aspects of lived love relationships that were not compatible with the dominant, etherealized ideology of love--such as extramarital relationships, domestic violence, and the ephemerality of many sexual partnerships--were largely banished from the established popular musical culture. Yet these very themes pervade the blues. What is even more striking is the fact that initially the professional performers of this music--the most widely heard individual purveyors of the blues--were women. Bessie Smith earned the title "Empress of the Blues" not least through the sale of three-quarters of a million copies of her first record.

And a little more, why not.

The blues did not entirely escape the influences that shaped the role of romantic love in the popular songs of the dominant culture. Nevertheless, the incorporation of personal relationships into the blues has its own historical meanings and social and political resonances. Love was not represented as an idealized realm to which unfulfilled dreams of happiness were relegated. The historical African-American vision of individual sexual love linked it inextricably with possibilities of social freedom in the economic and political realms. Unfreedom during slavery involved, among other things, a prohibition of freely chosen, enduring family relationships. Because slaves were legally defined as commodities, women of childbearing age were valued in accordance with their breeding potential and were often forced to copulate with men--viewed as "bucks"--chosen by their owners for the sole purpose of producing valuable progeny. Moreover, direct sexual exploitation of African women by their white masters was a constant feature of slavery. What tenuous permanence in familial relationships the slaves did manage to construct was always subject to the whim of their masters and the potential profits to be reaped from sale. The suffering caused by forced ruptures of slave families has been abundantly documented.

Given this context, it is understandable that the personal and sexual dimensions of freedom acquired an expansive importance, especially since the economic and political components of freedom were largely denied to black people in the aftermath of slavery. The focus on sexual love in blues music was thus quite different in meaning from the prevailing idealization of romantic love in mainstream popular music. For recently emancipated slaves, freely chosen sexual love became a mediator between historical disappointment and the new social realities of an evolving African-American community. Ralph Ellison alludes to this dimension of the blues. I think, when he notes "their mysteriousness ... their ability to imply far more than they state outright and their capacity to make the details of sex convey meanings which touch on the metaphysical."
Sexuality was central in both men's and women's blues. During the earliest phases of their history, blues were essentially a male phenomenon. The archetypal blues singer was a solitary wandering man accompanied by his banjo or guitar, and, in the words of blues scholar Giles Oakley, his principal theme "is the sexual relationship. Almost all other themes, leaving town, train rides, work trouble, general dissatisfaction, sooner or later revert to the central concern." In women's blues. which became a crucial element of the rising black entertainment industry, there was an even more pronounced emphasis on love and sexuality.

The representations of love and sexuality in women's blues often blatantly contradicted mainstream ideological assumptions regarding women and being in love. They also challenged the notion that women's "place" was in the domestic sphere. Such notions were based on the social realities. of middle-class white women's lives, but were incongruously applied to all women, regardless of race or class. This led to inevitable contradictions between prevailing social expectations and black women's social realities. Women of that era were expected to seek fulfillment within the confines of marriage, with their husbands functioning as providers and their children as evidence of their worth as human beings. The sparsity of allusions to marriage and domesticity in women's blues therefore becomes highly significant.

In Bessie Smith's rendition of "Sam Jones Blues," which contains one of the few commentaries on marriage to be found in her body of work, the subject is acknowledged only in relation to its dissolution. Her performance of this song satirically accentuates the contrast between the dominant cultural construction of marriage and the stance of economic independence black women were compelled to assume for their sheer survival
